Guardianships | Elder Abuse
Elder Law is concerned with the welfare of the elderly - their health, social and
financial care. This area of law establishes guidelines that address not only planning,
but also for prevention of elder abuse, neglect and exploitation.
Planning for Elder Care
There may come a time when you or your parents are unable to manage your affairs.
As the elderly lose their physical and mental capabilities, they are unable to handle
finances and activities of daily living.
Elder law is in place to provide legal options which help at each stage of diminished
capacity, and having the right legal remedy in place can bridge the challenges you
face. At the law firm of Susan K. Holliday, the legal help we offer includes:
- Long-term care planning
- Asset transfers
- Conservatorships
- Guardianships
- Fraud/deceptive practices
- Durable powers of attorney
- Wills
- Trusts
Asset Management for the Elderly
Qualifying for Medi-Cal requires legal planning for asset management. Our firm can
assist you through strategies that involve paying off debts, permissible spending,
conversion of non-exempt assets to exempt assets, transfer of assets from a spouse
in a nursing home to a spouse living at home, or other financial handlings.
Preventing Elder Abuse
Congress passed the Nursing Home Reform Act in 1987 to set standards for assisted
living and nursing homes that prevented elder abuse. The act includes The Residents'
Bill of Rights, which guarantees the following:
- The right to freedom from abuse, mistreatment, and neglect
- The right to freedom from physical restraints
- The right to privacy
- The right to accommodation of medical, physical, psychological, and social needs
- The right to participate in resident and family groups
- The right to be treated with dignity
- The right to exercise self-determination
- The right to communicate freely
- The right to participate in the review of one's care plan, and to be fully informed
in advance about any changes in care, treatment, or change of status in the facility
- The right to voice grievances without discrimination or reprisal
Many signs indicate possible elder abuse such as physical injuries, malnutrition,
dehydration, depression, sudden weight loss and other symptoms of mistreatment.
Nursing homes and assisted living residences may try to cover up elder abuse or
neglect in an effort to avoid liability. For this reason, if you have a parent,
relative or spouse in a nursing home or long-term care facility, you should be vigilant
for indications of unacceptable, substandard elder care.
If you or a loved one is a victim of elder abuse, we encourage you to seek legal
advice immediately to stop the abuse and prevent further harm.
